When Should You Call a Personal Injury Lawyer?

Photo of Lawyer

Injuries can happen without any warning and impact your life forever. If you or someone you know has been hurt in an accident due to someone else’s negligence and carelessness, you have the legal right to seek monetary compensation.

If you have been injured in an accident, you should first seek medical care. Nothing is more important than your health—it’s the only thing you have. Accidents can cause terrible injuries like traumatic brain injury (TBI), internal bleeding, broken bones, and more. The next step is hiring a personal injury attorney to help you.

Victims are convinced that they can negotiate with the insurance company by themselves. This is the main reason why many people don’t call an attorney right away after an injury. It is a common misconception that the insurance company will work reasonably and fairly with you and help you recover the total amount of compensation you are entitled to.

The reality is that insurers will always try to pay as little as legally possible, and in these cases, only an experienced personal injury lawyer can help you.

For those reasons and various others, victims hesitate to call a New York personal injury lawyer after they have experienced an accident or injury. It’s good to bear in mind that getting legal aid as soon as you can is always the best thing to do for yourself. Failure to do so could make you miss your chance of fully asserting your legal rights and getting the maximum amount of compensation . At Isaacson, Schiowitz & Korson, LLP, we are here to provide assistance.

Can You Sue for Personal Injury?

Personal injury lawsuits are extremely common types of civil actions. Suppose you are successful in your personal injury claim or wrongful death claim. In that case, you could be entitled to damages.

The Elements of a Personal Injury Claim

It’s important to note that not every type of accident or injury can result in a personal injury claim. Typically, in order to file a personal injury claim, it should satisfy the following:

  • First, an injury must have happened. If an accident occurs, like a minor fender-bender, that didn’t result in an injury, you likely will not have a claim. In order to have a personal injury claim, you must be able to prove that damage occurred. If an accident occurred directly because someone else was acting negligently, then you may have a case. Legally speaking, negligence means that someone failed to provide the proper duty of care to someone else.
  • You must be able to prove that someone’s negligence caused your injury. There are many kinds of personal injury cases, including medical malpractice, slip and fall cases, wrongful death claims, and car accidents. They may all have different circumstances, but in each one, you must be able to prove negligence and that the negligence caused you harm.

Damages in a Personal Injury Claim

All personal injury cases are different, and many elements can affect the amount of monetary compensation you can recover.

These damages can include:

  • Current and future medical bills
  • Therapy and rehabilitation
  • Lost wages
  • Loss of earning capacity
  • Property damage
  • Pain and suffering
  • Emotional distress
  • Loss of enjoyment of life

Punitive damages may be awarded if the responsible party was particularly reckless. While only 5% of all personal injury cases settle before trial, the settlement amounts are generally determined by what the parties expect a jury to decide. Various factors can be taken into consideration when trying to determine the amount of compensation, including the severity of your injuries, the extent of your recovery, if any lasting disability is expected, or if the fault is clear-cut

If you have suffered pain and suffering due to someone else's fault, you have the legal right to seek compensation from those who have harmed you. Contact Isaacson, Schiowitz & Korson, LLP to schedule a free consultation and discuss your legal options.

How are Pain and Suffering Calculated in New York City?

It's essential to know that not all damages are treated equally. While some are created to cover the losses you suffered from your injury, others are pretty speculative because they cover losses that are hard to measure. For example, pain and suffering. In New York City, there are two ways to calculate pain and suffering damages, such as the multiplier method or the per diem approach.

The multiplier method is commonly used in NYC. After you know the total amount of your economic damages, including lost wages and medical bills, the amount is multiplied anything from 1.5 to 5 times. The more severe your injury is, the higher the multiplier.

On the other hand, the per diem (per day) approach is not related to economic damages. Instead, it assigns a daily amount to your pain and suffering. The rate is usually reasonable, such as $200 or a day's wages. When calculating pain and suffering damages, one takes into consideration the following:

  • The impact on your daily life
  • If you have suffered from anxiety or depression
  • If you have lost your appetite or have sexual dysfunction
  • If it has impacted your relationships
  • The length of your expected recovery
  • If your injury could affect your life expectancy

How Can a New York City Personal Injury Lawyer Help You?

If you have been severely injured and find yourself anxious, confused, and worried about what to do next, you should contact a personal injury lawyer as soon as you can.

The legal process can be challenging and confusing if you don’t know what you are doing. Trying to tackle this yourself would be like going on a hike in the woods without a map or a compass. While it can be done, it’s highly inadvisable.

Only a professional lawyer has the legal knowledge, experience, and skill to keep you from getting lost. That’s where Isaacson, Schiowitz & Korson, LLP, can assist you.

At Isaacson, Schiowitz & Korson, LLP, our personal injury lawyers work hard to make your life a little easier. We provide our clients peace of mind because they know that we are pursuing maximum compensation. We are always here to answer any questions and to update you on the status of your claim. The Advantages of Hiring a Personal Injury Lawyer?

Our talented team of New York personal injury lawyers can help you achieve the best possible outcome for your claim. We can determine and pursue every type of damage you are entitled to. This may include a variety of benefits, including reimbursement for current and future lost wages, medical bills, pain and suffering, property damage, loss of consortium, emotional trauma, and more. We will go over your case with you and let you know what you might be entitled to.

We also work with you to determine the most effective legal strategy for your particular claim. Fighting insurers can be very complex. Your case is unique, but in most scenarios, insurance companies and responsible parties will not voluntarily pay the total amount of compensation that you are owed. Hiring an experienced lawyer who thoroughly knows the law and can pursue the correct legal strategy will help ensure that you receive the most available compensation.

Your personal injury attorney can help relieve any stress and anxiety you might have about your case. If you have suffered an injury, you should focus on healing and moving forward, not fighting an insurance company when you aren’t knowledgeable about the law. Leave the battle to us.

What Is the Statute of Limitations for Personal Injury Claims in NYC?

New York’s statute of limitations regarding personal injury cases can depend on the circumstances of your claim. Generally, if you have been injured, you have three years from the date of the accident to file a lawsuit in NYC.

You may have a reduced filing timeline if your claim involves a medical malpractice claim or a government entity. Since there are so many variables and circumstances that need to be considered with your claim, it is vital that you consult with a personal injury attorney immediately after your accident. This guarantees that you never miss any critical deadlines and thereby surrender your right to seek compensation from the at-fault party.

However, there are some exceptions to the rule. For medical malpractice cases, you only have two and a half years. If your case involves a government agency, then you have 90 days to file your personal injury claim and one year to file a lawsuit.

After a severe injury, it's understandable that your focus is on recovering your health. But as time passes on, please keep in mind that evidence may get lost and memories may fade. All of these could considerably affect the monetary compensation you are able to recover. If you're postponing your legal process for too long, the statute of limitations may run out. This means you won't have the chance of getting the compensation you deserve.

They demonstrated incredible knowledge and experience in all facets of law. I am both proud and confident to recommend this firm to anyone I encounter in need of their extraordinary services.”
